Welcome to the International Personal Trainer Academy. These Terms and Conditions govern your access to and use of IPTA’s services, products, and online content. By accessing or using any part of our services, you agree to be bound by these terms. If you do not agree to all the terms and conditions, you must not use or access our services.
1. Acceptance of Terms
1.1 By enrolling in a course, accessing our materials, or purchasing our offerings, you confirm your acceptance of these terms and your agreement to be a party to this binding contract. If you do not agree, do not use the International Personal Trainer Academy’s services.
2. Subscription Services
2.1 We offer various subscription options for our materials and courses which may be accessed on a recurring monthly basis until cancelled by you.
2.2 Monthly subscriptions automatically renew each month on the same day of the original purchase, and your payment method will be charged accordingly until you cancel.
2.3 You can manage or cancel your subscription through your Trainer Academy account settings or request a cancellation with our support team.
2.4 In the event of a price change, current subscribers will receive a 30-day notice prior to charges.
2.5 Subscription updates are non-refundable, the subscription must be canceled prior to the date of update.
2.6 Subscription Pausing:
- 2.6a Eligibility for Pause: Subscribers may pause their subscription for a minimum of one month and a maximum of three months.
- 2.6b Requesting a Pause: To initiate a subscription pause, subscribers must submit a request through their International Personal Trainer Academy account profile page.
- 2.6c Effects of Pausing: During the pause period, access to subscription-based resources will be suspended. The subscription and associated charges will automatically resume at the end of the pause period without the need for any additional action by the subscriber.
- 2.6d Billing During Pause: There will be no charges during the pause period. The billing cycle will extend by the duration of the pause.
- 2.6e Resumption of Services: At the end of the pause period, the subscription will automatically reactivate, and billing will resume on the new adjusted billing date which accounts for the pause duration.
- 2.6f Cancellation During Pause: If a subscriber chooses to cancel their subscription during the pause period, the cancellation will take effect immediately without a refund for any previous payments.
3. General Account Registration
3.1 To access certain services, such as monthly subscriptions for study guides, you must create an account with the International Personal Trainer Academy.
3.2 You are required to provide current, complete, and accurate information during the registration process.
4. International Personal Trainer Academy CPT (IPTA-CPT) Certification Registration
4.1 Applying for the International Personal Trainer Academy CPT (Certified Personal Trainer) program requires a separate, more rigorous registration process.
4.2 As a CPT applicant, you must provide detailed and precise information, which may include, but is not limited to, your educational background, proof of identity, and professional credentials.
4.3 This information must be verified for accuracy at the time of application and you are obligated to update this information promptly if any changes occur during your certification process.
5. Account Responsibilities
5.1 For all accounts, whether for study guide subscriptions or IPTA-CPT certification, you are responsible for maintaining the confidentiality of your account credentials.
5.2 You agree to accept responsibility for all activities that occur under your account.
5.3 You certify and represent that you will be the person using the products and services for which you have registered.
5.4 Your account, subscription, enrollment, license, guarantee rights, and any access granted through the services are personal to the registered user and are non-transferable unless IPTA expressly agrees otherwise in writing.
5.5 You may not share, disclose, sell, assign, transfer, sublicense, lend, lease, or otherwise permit any other person or entity to use your account, username, password, access code, or other access credentials, and you may not permit any third party to access paid materials through your account, whether that person is a friend, family member, coworker, employer, employee, student, or client.
5.6 You may not allow any other person to complete coursework, quizzes, practice tests, confidence score activities, guarantee requirements, certification tasks, or any other activity under your account on your behalf.
5.7 If IPTA reasonably suspects unauthorized account sharing, credential sharing, transfer, or other multi-user access inconsistent with the personal, single-user nature of the account or license, IPTA may require identity verification and may suspend or terminate access, invalidate progress, deny or revoke guarantee eligibility, withhold, suspend, or revoke certificates, certifications, badges, transcripts, exam eligibility, or verification status, and refuse future purchases or enrollments, to the extent permitted by law.
5.8 The International Personal Trainer Academy reserves the right to suspend or terminate your account if any provided information proves to be inaccurate, not current, or incomplete.
6. Account Security
6.1 You agree to immediately notify the International Personal Trainer Academy of any unauthorized use of your account or any other breach of security.
6.2 Trainer Academy will not be liable for any loss or damage arising from your failure to comply with this security obligation.
7. Fees and Payments
7.1 The International Personal Trainer Academy accepts payments through various methods, including credit cards and PayPal and more.
7.2 By subscribing to our services or purchasing our products, you agree to pay all applicable fees or charges to your account based on the International Personal Trainer Academy’s fees, charges, and billing terms in effect at the time.
7.3 For the Exam Pass Guarantee, the preferred payment method is Paypal.
8. Refund Policy
8.1 Subscriptions: Subscribers to recurring products or services may cancel future renewals at any time. Cancellation stops future recurring charges only and does not entitle the customer to a refund except as expressly provided in this Section 8.
8.2 Non-Subscription Purchases: Refund eligibility for one-time or lifetime purchases varies by product category.
8.3 IPTA Certification Products: Purchasers of IPTA-branded certification products, including IPTA CPT and other IPTA certifications offered directly by IPTA, may request a full refund within thirty (7) days of purchase. This 7-day money-back guarantee applies only to IPTA certification products unless otherwise expressly stated in writing at the time of purchase.
8.4 Third-Party Study Materials: Purchasers of third-party study materials, including monthly subscriptions and lifetime-access products for non-IPTA certifications, exam-prep courses, or study systems, may request a refund within forty-eight (48) hours of purchase. After the applicable 48-hour period expires, no refund, cancellation, or return will be granted for such products except where required by applicable law.
8.5 Orders Containing Multiple Product Categories: If a single order or bundle includes both IPTA certification products and third-party study materials, the refund eligibility for each component will be determined by the specific written terms disclosed at checkout or, if no separate terms are disclosed, by the category-based rules in this Section 8.
8.6 Process: Refund requests must be submitted in writing within the applicable refund window by contacting IPTA support via website chat or email and providing sufficient purchase information to locate the order.
8.7 Refund Method: Approved refunds will be issued to the original payment method when reasonably available. If the purchase was made through an installment plan, or if the original payment method cannot accept the refund, IPTA may issue the refund to the most recent valid payment method used on the account or by another reasonable method determined by IPTA and its payment processor.
8.8 Effect of Installment Plans and Promotional First Payments: If you purchase through an installment plan, including any “Start for $1,” “$1 down,” or similar first-payment promotion, that amount is only the first installment toward the full purchase price and is not a free trial unless IPTA expressly states otherwise in writing at checkout. If you do not cancel within the applicable refund window, you remain responsible for all remaining scheduled payments under your purchase agreement.
8.9 No Avoidance of Payment Obligations: Cancellation of your account, non-use of the products or services, cancellation or replacement of your payment method, or initiation of a chargeback or payment dispute does not cancel or reduce the balance owed, except as required by applicable law or where IPTA approves a refund in writing.
9. The International Personal Trainer Academy Exam Pass Guarantee
9.1 Exam Pass Guarantee Overview: The International Personal Trainer Academy is committed to your success. If you utilize our MVP study program subscription or Lifetime MVP study program for your certification exam and fail, you are eligible for a refund of your purchase and the additional cost of the certification exam retake for the purchased program’s official exam. We will also upgrade your subscription to a lifetime membership to continue using and ensure you pass your exam.
- 9.1a – The NSCA CSCS retake fee, which is part of the MVP exam pass guarantee is $475 for non-members of the NSCA and $340 for members. If retaking only one section of the exam, it is $385 for non-members and $250 for members.
- 9.1b – The NASM CPT retake fee, which is part of the MVP exam pass guarantee is $199.
- 9.1c – The ACE CPT retake fee, which is part of the MVP exam pass guarantee is $249.
- 9.1d – The NSCA CPT retake fee, which is part of the MVP exam pass guarantee is $435 for non-members of the NSCA and $300 for members.
- 9.1e – The ACSM CPT retake fee, which is part of the MVP exam pass guarantee is $199.
- 9.1f – The ISSA CPT retake fee, which is part of the MVP exam pass guarantee is $99.
- 9.1g – The NCSF CPT retake fee, which is part of the MVP exam pass guarantee is $99.
- 9.1h – The NASM CES retake fee, which is part of the MVP exam pass guarantee is $99.
- 9.1i –The NASM PES retake fee, which is part of the MVP exam pass guarantee is $99.
- 9.1j –The NASM CNC retake fee, which is part of the MVP exam pass guarantee is $199.
- 9.1k – The ISSA Nutritionist retake fee, which is part of the MVP exam pass guarantee is $199.
9.2 Eligibility:
- 9.2a – You must have actively and consistently used our MVP study program as your primary study resource.
- 9.2b – Your exam confidence score within our study system must be in the green (color of confidence score inside LMS study system), indicating approximately 8,000 confidence points, before taking the certification exam.
- 9.2c – You must notify Trainer Academy within 30 days of receiving your certification exam results if you fail the exam.
- 9.2d – Purchases made prior to May 1st, 2024, will be subject to the former refund policy, which only excludes the additional exam cost fee paid by Trainer Academy.
- 9.2e – Exams must be taken within 30 days of the end of your subscription or within the subscription period.
- 9.2f – Your account must be current on all payments, with no default, chargeback, reversal, or unresolved payment dispute, at the time of the exam, at the time your claim is submitted, and at the time any refund or guarantee payment is processed.
9.3 Claiming the Exam Pass Guarantee:
- 9.3a – To claim under the Exam Pass Guarantee, contact our support team with official proof of your exam failure and evidence of your exam confidence score being in the green area of progress or having 8,000 confidence points.
- 9.3b – You must request your refund within the 30-day period following your exam date.
- 9.3c – The refund and exam pass guarantee payment does not count in the case of exams that are non-proctored and in cases where there is one-take limit to the exam.
- 9.3d – The refund and exam pass guarantee do not count towards retakes of the exam, only the initial exam attempt.
9.4 Refund Details: Refunds under this exam pass guarantee include the cost of your total subscription updates or study program and the additional cost of the certification exam retake for the purchased program’s official exam. *This does not include the subscription creation fee.*
9.5 Limitations for Paused or Unsubscribed Accounts: If a subscriber has paused or unsubscribed from their study program for a period exceeding three consecutive months prior to requesting a refund under the Exam Pass Guarantee, only the most recent subscription update or consecutive updates will be eligible for a refund. Earlier subscription payments, including those made prior to the 3-month lapse, will not be refunded or counted toward the guarantee.
10. Job Assurance Guarantee
IPTA provides a Job Assurance Guarantee to individuals who successfully complete the IPTA CPT Certification program.
10.1 Eligibility Criteria for the IPTA MVP Job Assurance Guarantee:
- 10.1a Achieve a passing score of 70% or higher on the IPTA CPT Certification exam.
- 10.1b Submit the Job Assurance Guarantee Request Form within 90 days of passing the IPTA CPT Certification exam.
- 10.1c Apply to at least three personal training positions within a 50-mile radius of your primary residence.
- 10.1d If approved, you will be refunded only the amount paid specifically for the Job Guarantee, which is considered a value of $99.
- 10.1e The Job Assurance Guarantee form should be filled out and sent to jobguarantee@traineracademy.org.
- 10.1f You must be current on all payments, with no outstanding balance, default, chargeback, reversal, or unresolved payment dispute on the account.
- 10.1g The program must be paid in full before any Job Assurance Guarantee claim is approved or paid.
- 10.1h If you purchased through an installment plan, you must have completed at least fifty percent (50%) of the total payment schedule without default at the time you submit the claim.
10.2 Important Notes:
- 10.2a All eligibility requirements must be fulfilled within the designated time frames to qualify for the refund.
- 10.2b Late or incomplete submissions of the Job Guarantee Request Form will not be considered for refunds.
11. Certification Recertification
11.1 Purpose and Rationale: Trainer Academy requires mandatory recertification every two years to ensure that certificants maintain and expand their professional knowledge and skills. Recertification supports ongoing professional development, keeps certificants updated on current practices, and acknowledges participation in continuing education activities. The two-year period aligns with the introduction of new practices and research in the field.
11.2 Recertification Due Dates:
- 11.2a Applications and fees are due 45 days prior to certification expiration.
- 11.2b Certificants are responsible for timely submission and retaining documentation of continuing education activities.
- 11.2c Courtesy reminders are sent via email, but timely application submission remains the certificant’s responsibility.
11.3 Recertification Options:
- 11.3a Continuing Education: Earn 24 Continuing Education (CE) credits through educational activities such as webinars, conferences, and online training aligned with the certification blueprint.
- 11.3b Examination: Pass the current certification exam before the expiration date. If the exam is failed, candidates may recertify through CE credits, provided the certification has not already expired.
11.4 Application Verification and Audits:
- 11.4a Trainer Academy reserves the right to verify information provided in recertification applications.
- 11.4b Approximately 5% of applications are audited, requiring evidence of completed CE activities (e.g., certificates).
- 11.4c Incomplete applications will be returned for correction and must be resubmitted by the deadline.
11.5 Recertification Acceptance:
- 11.5a Renewal notices are issued upon meeting all requirements.
- 11.5b Applications from individuals with suspended or revoked certifications will not be accepted.
- 11.5cCE activities are subject to Trainer Academy’s review and approval, and credit is granted only after completion and proper documentation.
11.6 Failure to Recertify:
- 11.6a Certifications expire if not renewed by the last day of the certification period.
- 11.6b Expired certificants may not use the CPT credential or represent themselves as certified until recertification is approved.
- 11.6c Non-renewed certificants are removed from the online verification registry and will receive official notification.
11.7 Reinstatement Policy:
- 11.7a Certifications expired for 90 days or less may be reinstated by meeting all recertification requirements, submitting a complete application, and paying the reinstatement fee.
- 11.7b The expiration date for reinstated certifications remains the same as if renewed on time.
11.8 Lapsed Certification:
- 11.8a Certifications expired for more than 90 days are considered lapsed.
- 11.8b To regain certification, individuals must reapply, pay the application fee, meet eligibility requirements, and pass the certification exam.
11.9 Recertification Appeals:
- 11.9a Individuals denied recertification may appeal within 30 days by submitting a written notice to the certification manager.
- 11.9b Appeals are reviewed by the Council or an appointed committee, with final decisions made within 45 days.
- 11.9c No new information may be submitted during the appeal process, and applicants will receive written notice of the final decision within 30 days of review.
12. Free First Recertification
12.1 The first recertification application fee for the certification is waived by IPTA for individuals who purchase a participating program package. To qualify, applicants must submit all required forms, documentation, and Continuing Education Units (CEUs) within the designated timeframe, as outlined in the certification’s handbook.
12.2 Completed recertification applications under the Free First Recertification guarantee must be submitted to recertification@traineracademy.org.
12.3 This offer applies exclusively to the first recertification, which must be completed within two years of the initial certification’s expiry date. Standard recertification rates will apply for all subsequent recertifications.
12.4 Late fees will apply if recertification is not completed by the specified deadline, two years after the date of completion, and enters the late submission period.
13. Unlimited Exam Retakes + Pass Guarantee: IPTA CPT MVP
13.1 Purchasers of the MVP Study Program for the IPTA CPT certification are eligible for unlimited exam retakes, provided they achieve a qualifying confidence score within the program. A qualifying confidence score is defined as 8,000 points or more out of the maximum 10,000 points available.
14. Free Online CPR/AED Certification: IPTA CPT MVP
14.1 Purchasers of the MVP Study Program for the IPTA CPT certification are eligible to receive the IPTA CPR/AED Certification Course at no additional cost. This offer can be redeemed using a coupon code provided at checkout for the CPR/AED course.
14.2 This offer is valid only for the initial certification. For subsequent recertification submissions, the CPR/AED course will be available for purchase at the standard rate of $99.
15. Intellectual Property
15.1 – All materials, including courses, content, logos, and trademarks, are owned by the International Personal Trainer Academy or its licensors.
15.2 – You may not use, alter, or distribute these materials except as explicitly authorized through a licensed agreement.
16. License and Access
16.1 The International Personal Trainer Academy grants you a limited, non-exclusive, non-transferable license to access and use the International Personal Trainer Academy materials for your personal and non-commercial use.
16.2 This license does not include any resale or commercial use of any International Personal Trainer Academy service or its contents.
17. Limitations on Use
17.1 You may not modify copies of any materials
17.2 You may not use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.
17.3 You may not reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying ideas or algorithms of any part of the services.
17.4 You may not rent, lease, loan, sell, sublicense, distribute, copy, translate, modify, adapt, improve, or create derivative works from any part of the services or included content.
17.5 You may not use the services or materials for any commercial purpose or for any public display (commercial or non-commercial).
17.6 You may not attempt to access unauthorized areas of the services, interfere with the technical aspects of the services, or evade measures used to prevent or restrict access to the services.
17.7 You may not share or permit third-party use of your account, access credentials, or paid materials obtained through the services in a manner inconsistent with personal, single-user use.
18. Termination and Account Cancellation
18.1 The International Personal Trainer Academy may terminate or suspend your account and bar access to the services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the services or manually cancel through your account management page.
19. Installment Plans
19. Installment Plans
19.1 IPTA may offer installment payment plans for certain products and services, including promotional first-payment offers. A valid payment method must be provided to initiate and maintain an installment plan.
19.2 By selecting an installment plan, you agree to pay the full purchase price, applicable taxes, and disclosed fees, and you authorize IPTA and its third-party payment processors to charge each installment to your payment method on or after its scheduled due date until the balance is paid in full, subject only to any refund rights timely exercised under Section 8.
19.3 Any “Start for $1,” “$1 down,” or similar promotional offer is only the initial installment and is not a free trial unless IPTA expressly states otherwise in writing at checkout.
19.4 Cancellation, expiration, replacement, or modification of your payment method, or your decision to stop using the products or services, does not release you from the obligation to fulfill the remaining installment payments.
19.5 Except where restricted by applicable law, IPTA may declare your installment plan past due or in default under the following conditions:
- 19.5a If a scheduled payment cannot be processed, is declined, returned, reversed, charged back, or is not received in full, and the full amount due is not received within five (5) business days after the scheduled due date.
- 19.5b If you fail to maintain a valid payment method on file.
- 19.5c If you initiate a chargeback or payment dispute on any installment or other amount due and the dispute is not resolved in IPTA’s favor.
- 19.5d If any event occurs that, in IPTA’s reasonable judgment, significantly impairs your ability or willingness to meet your payment obligations.
19.6 If your installment plan is past due or in default, IPTA may, without prior notice and in addition to any other rights or remedies available under these Terms or applicable law:
- 19.6a Suspend or terminate your access to IPTA products and services.
- 19.6b Place your account or any related certificate, certification, badge, transcript, verification listing, or eligibility status on hold or in suspended status.
- 19.6c Deny or delay access to online materials, quizzes, exams, final exams, certificates, certifications, digital badges, transcripts, recertification, renewals, promotions, discounts, guarantees, or other benefits until the account is brought current or paid in full, as applicable.
- 19.6d Invalidate promotional pricing, bonuses, discounts, bundles, add-ons, or guarantee eligibility associated with the purchase, to the extent permitted by law.
- 19.6e Refuse future purchases, renewals, enrollments, or installment plans.
19.7 The opportunity to purchase products or services using an installment plan is a privilege and not a right. Unless a valid refund is granted under Section 8, you remain responsible for all scheduled installment payments even if you complete your program, fail to complete your program, stop using the products or services, or do not sit for or complete any exam.
19.8 For IPTA certification products, IPTA may require that your account be current on all scheduled payments and in good standing, or paid in full where stated at checkout or in product-specific terms, before allowing you to sit for a final exam, issuing a certificate or certification, releasing a digital badge or transcript, verifying a credential, processing recertification, or honoring any guarantee claim. Without limiting the foregoing, IPTA may require a minimum of two (2) successfully processed installment payments before granting final exam access.
19.9 For third-party study materials, IPTA may require that your account be current on all scheduled payments before continuing access, extending access, or processing any Exam Pass Guarantee claim or related refund.
19.10 Restoration of access after a default, hold, or suspension is at IPTA’s sole discretion once all past-due amounts and any other lawfully due amounts have been paid or otherwise resolved.ement may result in a delay or denial of exam access until the requirement is met.
20. Default of Payment
20.1 If an installment plan is declared past due or in default, IPTA reserves the right, where legally permitted, to declare the full remaining unpaid balance immediately due and payable.
20.2 IPTA may pursue unpaid amounts through internal collection efforts, third-party collection agencies, legal action, arbitration, assignment, sale, or any other lawful recovery method.
20.3 In the event of a past-due or defaulted account, the account holder will be responsible, to the maximum extent permitted by law, for all reasonable costs of collection and enforcement actually incurred by IPTA, including reasonable attorneys’ fees, court costs, arbitration fees, and third-party collection costs.
20.4 Except where prohibited by applicable law, delinquent or defaulted accounts may be referred to authorized servicing or collection partners and may be reported to consumer reporting agencies, which may negatively affect your credit history.
20.5 IPTA may sell, assign, or transfer all or part of the outstanding balance, payment stream, or servicing rights under an installment plan to a third party at any time.
20.6 If an account remains past due or unresolved for more than thirty (30) cumulative days, IPTA may place the account in “Not in Good Standing” status. While in “Not in Good Standing” status, the customer may lose account access, product access, exam eligibility, guarantee eligibility, renewal or recertification eligibility, and any associated IPTA credential may be identified as suspended or not in good standing in IPTA records and any IPTA or partner verification tool.
20.7 If an account remains in “Not in Good Standing” status for more than ninety (90) cumulative days, IPTA may revoke or permanently suspend any associated IPTA certification or credential and may deny recertification or renewal until the account is fully resolved.
20.8 To clear a default or “Not in Good Standing” status, you must satisfy the past-due balance and any other amounts lawfully due and contact IPTA support to request reinstatement, if reinstatement is available.
21. Changes to Terms and Services
21.1 We reserve the right, at our sole discretion, to modify or replace these terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect.
21.2 What constitutes a material change will be determined at our sole discretion. We also reserve the right to alter or discontinue any aspect of our services at any time, including, but not limited to, content, features, and access methods.
22. Governing Law
22.1 These terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights. If any provision of these terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect.
23. Limitation of Liability
23.1 In no event will the International Personal Trainer Academy, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
24. Dispute Resolution
24.1 You agree to first attempt to resolve any dispute informally by contacting us. If a dispute is not resolved within 30 days of submission, you or the International Personal Trainer Academy may resolve any disputes arising under these terms through binding arbitration in accordance with the provisions of this Agreement.
